1. Acceptance of Terms

Welcome to OFFLINE. By accessing or using our website, joining our waitlist, or downloading and using the OFFLINE mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the Service.

OFFLINE is currently in active BETA & Early Access stage. Features may evolve, update, or be modified as we refine the experience.

2. Eligibility & Account Security

You must be at least 13 years old (or the minimum legal age required in your country) to use OFFLINE. By creating an account or joining the waitlist, you confirm that you meet this requirement.

You are responsible for safeguarding your login credentials and for any activity under your account. You agree to notify us immediately of any unauthorized access.

3. Real-World Safety & Exploration Guidelines

OFFLINE connects digital memories to real-world physical locations. Because exploration occurs in the real world, your physical safety and respect for local communities are paramount:

  • No Trespassing: You must never enter private property, restricted zones, dangerous infrastructure, or closed areas without lawful authorization to capture or view a Trace.
  • Obey Local Laws: Always respect local regulations, signs, curfews, and environmental protections.
  • Situational Awareness: Never use OFFLINE while driving, cycling, operating machinery, or in situations where distraction could result in bodily injury.
  • Assumption of Risk: You acknowledge that real-world exploration involves inherent physical risks. You assume full and sole responsibility for your personal safety, surroundings, and conduct. OFFLINE accepts no liability for physical accidents, personal injury, or property damage.

4. User-Generated Content & Zero-Tolerance Policy

OFFLINE is dedicated to authentic, meaningful moments. We maintain a strict zero-tolerance policy for objectionable content and abusive behavior:

  • Prohibited Content: You may not publish content that is illegal, defamatory, obscene, sexually explicit, abusive, harassing, hateful, threatening, or that promotes violence or self-harm.
  • No Impersonation or Spam: Automated scraping, botting, commercial spam, and impersonating other individuals or entities are strictly forbidden.
  • Reporting & Moderation: Users have access to in-app reporting and blocking tools. OFFLINE reserves the right to review, flag, or remove any violating content within 24 hours and immediately suspend or permanently terminate offending accounts without prior notice.

5. Content Rights & Intellectual Property

Your Content: You retain full copyright and ownership of the photos, text, and Traces you create. By publishing content to public areas of the map, you grant OFFLINE a worldwide, royalty-free, non-exclusive license to host, display, adapt, and distribute your content solely for the purpose of operating, improving, and promoting the Service.

OFFLINE Property: The OFFLINE name, visual identity, logo, 3D design components, code, and interfaces are the exclusive intellectual property of OFFLINE and are protected by international copyright and trademark laws.

6. Waitlist & Founder Access Waves

Submitting an email or handle to the waitlist grants you priority consideration for access waves, but does not guarantee immediate access to the application. Early access invites and "Founder" status are granted at the sole discretion of the OFFLINE team based on city rollouts and community capacity.

7. Disclaimers ("As Is")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFFLINE, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.

9. Termination

We reserve the right to suspend or terminate your account or access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in harmful behavior, or for any legitimate security reason. You may delete your account at any time within the app settings.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy and the European Union, without regard to conflict of law principles. Any legal disputes shall be submitted to the competent courts of Italy.
